I got caught speeding on the 14th September 2009. I produced my license within the 7 days.
I hear nothing and thought I'd got away with it, however when I got back off holiday there was I nice letter with a summons to court asking me how I want to plead, guilty or not guilty obviously if I plead not guilty I don't attend I just pay the fine and take the 3 points.
A fair few people are telling me that I should contest in court as there is a time limit on when u have to be notified, some say 14 some say 28 days and the letter I received was dated 27th January 2010 so it would have arrived through my door on the 28th.
Personally I don't no what the laws are or what I should do in this instance, do I take the fine and points or go to court and try my luck??
Has anyone else been involved in similer circumstancs ? Or have any advice to give?

Citizens Advise Bureau mate! (if spelt right?) they can help you, but to be honest alot of people think they know alot of things but the only way to be sure is to ask the police.

Hi Craig The maximum time the police can respond is 6 months so I am afraid they have responded in time. A court summons usually means they are considering more than 3 points (normally you would just get 3 points and a £60 fine for minimal speeding). www.pepipoo.com That site gives you all the info you will need, it also gives a calculator which estimates what your fine / points will be. I was caught speeding a little while back so this is all still fresh in my mind

Thanks chris but I can't find anything reguarding a time limit ?
Also I have the option to plead guilty, so does this mean I state my plea then they will let me know of the fine and points the offence is worth ? I was doing 46 in a 30

Just plead guilty and take the points unless you already have 9 points then get yourself a good lawyer unless you want to have 6 month ban. It should only be 4 points for that speed in a 30 i think. 16mph or more over speed limit is 4 point not 3! Usually between 35 - 46 mph they just give you a fix pen!

I use a specialist speeding lawyer, who has got me off with a fine at 125mph. She represents a number football players.
If you would like the number, just let me know.

A footballers lawyer! Craig, just take your medicine and opt for the cheap option. I hope you weren't speeding in my car btw...

Also I said I would attend 1 of those speeding courses and the copper said that I was going too fast as ????
It's funny really as the cops were parked off the main road ( not visable ) an stood with the camera about 20 yrds from the 40 zone. I honestly thought the road was a 40 and told the cops when asked how fast I was going I said about 40 he u was doing 46 then he asked what's the speed limit ? I said 40 he said no it's a 30 - shafted !!!

youve been caught breaking the law doin 46 in a 30,you shouldnt be lookin to get out of it,just pay the fine and accept the points.

cd this is chrismelling pal. conraked is talking trash.the maximum u will recieve is 56 days for that offence but most people when they get banned get 28 days depends what kind of day the judge is having.. believe me i know. i got caught doing 110mph in a 60 and i already had 6 points in the end i got £360 fine and 5 points no ban. my advicce would be plead guilty and take the £60fine and 3 points not 4. trust me pal

This is Ossie on his own login again. I too would accept the points and fine. Will still be 3 points but i just think they want to take you to court to increase the fine. normally £60 but with court i reckon it will be £150 fine and the 3 points.
if you contest it and lose, both are increased, ie: 4 points and £250 fine etc... Crazy but true.
good luck - but i would bite my tongue, plead guilty and pay.

Ozzy is correct, just read all the post's and if what your saying is true your going to court for a increase in the fine, unless you have already got to many points on your current licence that is????.......... I'd go on your own and plead guilty and say sorry, beware as they WILL read out every single thing you said to them at that time. they will then make a decision on what happens next...... I just find the whole thing little odd to be honest that 46 in a 30 zone and you off to court????. Are you sure there isn't something that you havent told us????
I did 111mph in leeds in Feb, letter arrived in May, Court in the June and i got a £650 fine and six points, always better to take points rather than a ban, as you must declare a Ban to your insurance company for 5years, some insurance's even ask if you've ever lost your licence. this applies even if its just for a month.......
So Craig 'Take the Fine' and crack on son........... you could always play a few money match's to make it back......

46 in a 30 sounds more than 3 points to me I am afraid (probably 4), I think that is probably why you will need to appear in court (plus as Oz said the £60 fine will probably be bumped up a bit).
Certainly will not be a ban as a first time offender though.

I don't have to go to court I can plead guilty by post and get a discount on the fine. I did produce my documants a day late too  I just taking my punishment thanks all
